Man shot three times in car chase/gun battle

Three men were driving on the Northeast side just before 4 a.m. Sunday morning, when they say, found themselves under fire.

The driver said he’d just picked up  his cousin and a friend from the nigh club Suite 38. From there, they stopped at the Marathon gas station on 38th St. and High School Rd. As they continued toward 34th St., the three men say, someone opened fire on their vehicle.

The passenger in the back seat said the shots were coming from a car driving behind them. So, he grabbed his own gun and returned fire. He was shot three times in the back and side. Police say that passenger does have a valid handgun permit.

After the shooting, the driver pulled into a Denny’s parking lot where an off-duty officer saw the commotion and called for help.

The victim was taken to the hospital, where he was talking and aware. There is no other word on his condition. There were no other injuries.

The car that began the shooting fled.

Both men who had been at Suite 38 say they hadn’t had any issues with anyone. IMPD is investigating.
