Former Delaware County corrections officer charged with raping Ball State student

MUNCIE, Ind. — A former corrections officer for the Delaware County Jail has been charged with raping a Ball State University student.

The victim told police that Benjamin Upchurch sexually assaulted her in a Muncie home in early January 2016.

The victim said the alleged rape took place after she went to bed following a night of drinking with Upchurch.

An investigator conducted an interview with Upchurch in March, during which he said he didn’t know if he blacked out or passed out after the victim went to bed. When asked whether he forced himself on the victim, he said “If I was in my right mind no, but I honestly couldn’t tell you”

On Wednesday August 17, Upchurch was charged with rape and his bail was set at $20,000.
