Mom of inmate who escaped Fayette County Jail charged with assisting a criminal

FAYETTE COUNTY, Ind. – The mother of one of the inmates who escaped from the Fayette County Jail Saturday has been arrested after investigators say she provided the men with food and clothing when they came to her house.

“She did confess that the inmates went to her house once they escaped. She provided them with aid, gave them food and clothes,” says Sheriff Joey Laughlin.

Chadwick Heath and Michael Roberts escaped through a 2X2 foot hole in a cell early Saturday morning, according to the Fayette County Sheriff's Department.

Heath’s mother Paula Potters, 60, is charged with maintaining a common nuisance and assisting a criminal. Investigators say the maintaining charge comes from a review of phone calls done by investigators since the escape. The assisting a criminal charge comes from Potters confessing to assisting Roberts after the escape.

"They will be found. They will be back and be inmates at the Fayette County Jail again. They are going to do their time and do the time for the escape. There time is running out,” says Sheriff Laughlin.

Potters cannot be charged for assisting Heath, because he is her son and Indiana state law says someone cannot be charged with assisting a parent, child or spouse in evading arrest.

Potters told investigators that both men came to her house after the break out and she provided them with clothing and food.  She also provided additional information about their whereabouts that cannot be released at this time.

Joseph Heath has also been charged with maintaining a common nuisance, due to information obtained by listening to phone calls.
