CUMBERLAND, Ind.—A 13-year-old boy will be charged with murder as a juvenile in the shooting death of a 10-year-old Cumberland boy.

Anthony Harmon, Jr. died after he was shot in the head at Berkshire Square Apartments on May 27. He was found in the kitchen of an apartment and pronounced dead on the scene.

Cumberland police say the ages of the witnesses made the investigation difficult, because only young kids and teens were in the home at the time of the shooting. There were no adults in the apartment.

FOX59 spoke with Harmon’s family last week.  The boy’s father and older sister told FOX59 they didn’t agree with police initially investigating the shooting as a homicide. The boy’s family said it was a terrible accident and not intentional.

During the interview with the boy’s family, Harmon’s family expressed concern one of the other children would be charged in the 10 year old’s death.

“I believe that somebody was playing with a gun they didn’t have no business playing with and it accidentally went off and he got shot,” the boy’s older sister Lakesha Hamilton said.

A pre-trial conference is scheduled for June 30.
