Father charged in accidental shooting that injured 4-year-old daughter and her mother

INDIANAPOLIS, Ind.– A father is facing charges in connection with the accidental shooting of his 4-year-old daughter and her mother.

The incident occurred on Nov. 13 in the 1600 block of East 44th Street on the city’s north side. According to court documents, Kyle Spivey and his girlfriend were in their bedroom with their two children, ages two and four.

Investigators say the 2-year-old was able to get to Spivey’s loaded handgun off a dresser and fired a single shot, striking the 4-year-old girl in the face and her mother in the back of the head. The girl sustained serious injuries to her face, and her mother suffered an injury to the brain. She suffered vision loss in one eye.

Four other children were in the home at the time of the incident.

During the investigation, investigators found a photo allegedly posted by Spivey on social media about a week before the shooting. The photo shows the two children holding a gun.

Spivey was arrested Friday on charges of neglect of a dependent resulting in serious bodily injury, neglect of a dependent and criminal recklessness for leaving a loaded firearm where it could be accessed by a child.
