INDIANAPOLIS, Ind. – The father of a 3-year-old boy who fatally shot himself in 2013 has pleaded guilty.
Marion County Prosecutor Terry Curry announced today that Nicholas Gulling has been convicted and sentenced for the December 7, 2013, accidental shooting death of his 3-year-old son. Gulling pleaded guilty to neglect of a dependent and received a 20 year sentence.
Gulling and the child’s mother, Sandra Tomich, were charged after their son’s death. The child is believed to have accessed Gulling’s loaded handgun which was located on a kitchen counter in the family’s home and shot himself in the head.
The handgun was found to have no safety and no lock on it. In addition to the weapon with which the child shot himself, eight other firearms were found inside the home which were loaded, all of which had no trigger lock, and some of which were easily accessible to the children.
Six years of the sentence are to be served on Community Corrections and the remaining fourteen years were suspended. Gulling was ordered to be on probation for fourteen years after he completes the Community Corrections sentence. As a convicted felon, Gulling will be prohibited from possessing any firearms.
Under the guilty plea entered today, Gulling admitted culpability in the events leading up to the child’s death and the case against Tomich was dismissed.
